Modification of Texas Child Support Orders

Texas child support orders can be modified under the following conditions:

  • Circumstances (typically, the employment status of the parent paying child support) have changed substantially since issuance of the child support order; or
  • “[I]t has been three years since the order was rendered or last modified and the monthly amount of the child support award under the order differs by either 20 percent or $100 from the amount that would be awarded in accordance with the child support guidelines” under the current circumstances. Tex. Stat. Family Code Sec. 154.401.

It’s important to note that an informal agreement between the child’s parents is inadequate to modify either parent’s child support obligations. Child support obligations are imposed by order of the court, and failure to adhere to a court order can result in a finding of contempt. Also, just because you and your former spouse or partner are able to agree on a modification now, there is no guarantee that the modification will remain acceptable in the future. If a dispute arises, not only will you be held in contempt, you will also face possible jail time, and you will be liable for any amounts not paid, plus interest plus attorney’s fees and costs.

You should not deny visitation or interfere with his or her rights of joint conservatorship (child custody).
